SO THE APPLICANT IS REQUESTING TO REZONE PROPERTY FROM THE CURRENT SPLIT ZONING OF BUSINESS GENERAL B TWO AND INDUSTRIAL LIMITED M1 TO INDUSTRIAL GENERAL M TWO.
THE REZONING IS, HAS BEEN SUBMITTED WITH PROFFERS.
THEY'RE REQUESTING RE TO REZONE PROPERTY THAT CONTAINS APPROXIMATELY 29.90 ACRES, PLUS OR MINUS.
THE M TWO ZONING DISTRICT ALLOWS FOR INDUSTRIAL USES AS THE NAME IMPLIES.
THE SUBJECT PROPERTY, WHICH IS IDENTIFIED IN THE COUNTY'S RECORDS AS TAX PARCEL 21 DASH SEVEN DASH FOUR IS LOCATED ON THE SOUTH SIDE OF HOFHEIMER WAY IN NORTH DENWITTY.
THE COMPREHENSIVE PLAN INDICATES THAT THIS PROPERTY IS LOCATED WITHIN THE URBAN AREA, WHICH ALLOWS FOR INDUSTRIAL USES IN THE GENERAL AREA.
THE PROPERTIES SURROUNDING THE SUBJECT PROPERTY INCLUDE COMMERCIAL USES THAT ARE ACROSS HIGH FARM AWAY TO THE NORTH.
THOSE INCLUDE DOLLAR GENERAL AND A PARCEL THAT RO ROLIN FARM HAD REZONED IN 2016 TO B TWO NORTH OF THOSE PROPERTIES.
YOU HAVE THE AGRI NUTRIENTS FERTILIZER PLANT, WHICH IS OWNED INDUSTRIAL.
UM, OUT IN FRONT OF AGRI NUTRIENTS IS PROPERTY THAT IS OWNED BY DOMINION ENERGY.
UH, THAT PROPERTY IS CURRENTLY UNDEVELOPED, BUT THERE IS AN APPROVED SITE PLAN FOR THAT PROPERTY THAT PROPOSES A PRO PROPANE STORAGE FACILITY, UM, ADJOINING THE PROPERTY THAT IS OWNED BY DOMINION ENERGY.
YOU HAVE A PARCEL THAT IS OWNED BY PAMPHLET HISTORICAL PARK THAT PROPERTY'S OWNED A TWO AND THEN EAST OF THAT PROPERTY TRAVELING FURTHER EAST DOWN HOFHEIMER WAY.
YOU HAVE, UM, A FORMER, UH, TRUCKING FACILITY, UH, EDMUND'S TRUCKING FACILITY.
THAT SITE IS ZONED INDUSTRIAL ON THE SOUTH SIDE OF H HOFHEIMER WAY.
UM, ADJACENT TO THE SUBJECT PROPERTY ON THE WEST, YOU HAVE RON'S MUFFLER SHOP.
AND THEN, AS I MENTIONED EARLIER, A SMALL PORTION OF THE SUBJECT PROPERTY ZONE B TWO.

BUT MOST OF THE SUBJECT PROPERTY IS WITHIN THE CURRENT, UM, IN ONE ZONING.AND THEN SOUTH OF THE SUBJECT PROPERTY THERE IS LAND ZONED M1 AND A TWO THAT IS OWNED BY THE PAMELA FOUNDATION.
UM, AS I MENTIONED, THE SUBJECT PROPERTY IS LOCATED WITHIN THE URBAN AREA.
UM, AS OUTLINED IN THE COUNTY'S COMPREHENSIVE PLAN, THE URBAN AREA INDICATES THAT, UH, LIMITED COMMERCIAL AND INDUSTRIAL DEVELOPMENT IS APPROPRIATE WITHIN THIS AREA OF ROUTE ONE AND HOFHEIMER WAY.
AS SUCH, THE REQUESTED M TWO ZONING WITH PROFFERS IS COMPATIBLE WITH THE SURROUNDING COMMERCIAL AND INDUSTRIAL, UM, ZONING DISTRICTS.
THE POTENTIAL IMPACT OF THIS REQUEST ON PUBLIC SAFETY IS ANTICIPATED TO BE MINIMAL.
UM, THE PROPOSED BUILDINGS WILL BE DEVELOPED WITH FIRE PROTECTIONS AS REQUIRED BY APPLICABLE FIRE AND BUILDING CODES.
ADDITIONALLY, THE AREA HAS PUBLIC UTILITIES WHICH INCLUDE, UH, NATURAL GAS, PUBLIC, SANITARY, SEWER AND WATER, WHICH ARE ACCESSIBLE ALONG HOFHEIMER WAY AND AVAILABLE TO SERVE THE SUBJECT PROPERTY.
UH, WITH REGARDS TO IMPACTS ON TRANSPORTATION, UM, BASED ON INFORMATION THAT UH, THE DEPARTMENT RECEIVED FROM THE APPLICANT AND PRELIMINARY COMMENTS FROM VDOT, UH, THIS REQUEST DID NOT REQUIRE A CHAPTER 5 27 TRAFFIC IMPACT ANALYSIS.
VDOT HAS INDICATED THAT HOFHEIMER WAY HAS A FUNCTIONAL CLASSIFICATION OF LOCAL ROAD AND AN AVERAGE DAILY TRAFFIC VOLUME OF 2,800 VEHICLES PER DAY.
THIS ROAD WAS ORIGINALLY CONSTRUCTED AS AN ECONOMIC DEVELOPMENT ACCESS ROAD AND WAS DESIGNED TO ACCOMMODATE HEAVY TRUCK TRAFFIC.
UH, FOR THAT REASON, THE ROAD IS DEEMED SUITABLE FOR THE PROPOSED ZONING AND THE ASSOCIATED USES.
WHEN THE SUBJECT PROPERTY IS DEVELOPED.
UH, THE FUTURE TRANSPORTATION RELATED IMPROVEMENTS FOR ACCESS TO THE PROPERTY, WE WILL HAVE TO MEET, UH, VDOT DESIGN AND CONSTRUCTION REQUIREMENTS AT THAT TIME DURING THE SITE PLAN REVIEW PROCESS.
SO, AS I MENTIONED THERE, THERE ARE PROFFERS ASSOCIATED WITH THIS REZONING REQUEST.
THE THREE PROFFERS THAT HAVE BEEN PROPOSED BY THE APPLICANT CLUE, UH, NUMBER ONE, IT LIMITS THE USES ON THE PROPERTY TO GENERAL INDUSTRIAL USES.
AND THEN IT GOES FURTHER TO STATE THAT THE PROPERTY WILL NOT BE DEVELOPED FOR AN AIRPORT ASPHALT MIXING PLANT OR FLEA MARKET.
UH, THE SECOND PROPER STATES THAT ANY OUTDOOR STORAGE AREA WILL BE PROPERLY SCREENED SO THAT IT WILL NOT BE VISIBLE FROM HOFHEIMER WAY.
AND THEN THE THIRD PROFFER STATES THAT, UH, LIGHTING ON THE PROPERTY, EXCLUDING LIGHTING INSIDE THE BUILDINGS, LIGHTING ON INSTALLED ON THE PROPERTY WILL BE DIRECTED DOWNWARDS AND INWARD TO THE SITE TO AVOID, UH, CASTING LIGHTING ONTO ADJACENT PROPERTIES OR INTO THE NIGHT SKY.
SO BASED ON THE INFORMATION AS PRESENTED, STAFF HAS RECOMMENDED APPROVAL OF THIS REQUEST.
GIVEN THAT ONE, THE REQUESTED ZONING CLASSIFICATION OF M TWO WITH PROFFERS IS COMPATIBLE WITH THE SURROUNDING ZONING PATTERN AND LAND USES.
AND TWO, THE PROPOSED USE CONFORMS TO THE UNDERLYING USES RECOMMENDED IN THE URBAN AREA, SET FORTH IN THE COMPREHENSIVE PLAN.
