UH, THERE, UH, THE APPLICANT'S REPRESENTATIVE IS HERE THIS EVENING, UH, TYLER ROSA WITH WILLIAMS MULLEN TO REPRESENT THE APPLICATION. UH, THE REQUEST THIS EVENING IS FOR A CONDITIONAL USE, CONDITIONAL USE PERMIT TO CONSTRUCT AND OPERATE 190 FOOT, 95 FOOT STEEL MONOPOLE, WIRELESS TELECOMMUNICATIONS TOWER. AND ALONG WITH THAT, THERE IS A FOUR FOOT LIGHTNING ROD, UM, ALONG WITH THE, UH, TOWER, UM, WOULD ALLOW THEM, UH, SPACE FOR VERIZON WIRELESS AND THEN ALSO FOR ADDITIONAL, UH, BROADBAND CARRIERS ON THE TOWER. UH, THE SUBJECT PROPERTY IS, UH, IN 7.4 ACRES IN SIZE. UM, AND THE, UH, LEASE AREA IS, UM, 60 BY 60, UH, LEASE AREA, UH, IN THE COMPREHENSIVE LAND USE PLAN. THIS IS PART OF THE RURAL CONSERVATION AREA, AND IN THE RURAL CONSERVATION AREA IS ANTICIPATED, UH, THAT WE WOULD HAVE TO ACCOMMODATE FUTURE PUBLIC SERVICE FACILITY DEVELOPMENT, UH, FOR THIS GENERAL AREA OF THE COUNTY. UM, THEREFORE WE FEEL LIKE IT'S APPROPRIATE, UH, LOCATION, UH, WITH THE PLAN. UH, THE PROPERTIES AROUND THE SUBJECT PROPERTY, UM, HAVE AGRICULTURAL FORESTAL AND LOW DENSITY RESIDENTIAL USES. THE ADJOINING PROPERTIES ON THE WEST SIDE OF EZINE ROAD ARE ALL ZONED A TWO AGRICULTURAL GENERAL, AND THE PROPERTIES, UH, TO THE NORTHEAST ACROSS INE ROAD, UH, FROM THE PROPOSED TOWER SITE, ARE ALL ZONED, ARE OUR RESIDENTIAL CONSERVATIVE. UM, JUST TO NOTE, UH, COMMUNICATION TOWERS ARE ALLOWED, UH, WITH A CONDITIONAL USE PERMIT IN BOTH OF THOSE ZONING CLASSIFICATIONS. UH, ADDITIONALLY AS, UH, PART OF OUR ZONING ORDINANCE, UM, THERE ARE, UH, GOALS THAT ARE OUTLINED, UM, FOR APPROVING, UH, TOWERS. THAT'S THE ENCOURAGE THE LOCATION OF ANTENNA AND TOWERS IN AREAS WHERE THE ADVERSE IMPACT ON THE COMMUNITY [00:05:01] IS MINIMAL, UH, TO ACCOMMODATE. WHILE THERE'S TELECOMMUNICATION SERVICES TO COUNTY RESIDENCES, BUSINESSES AND TRAVELERS STRONGLY ENCOURAGES THE CO-LOCATION OF TELECOMMUNICATION EQUIPMENT ON EXISTING TOWERS, MAXIMIZE THE USE OF EXISTING TOWERS, MAKE AVAILABLE PUBLIC PROPERTY TO FAC TO FACILITATE THE DEPLOYMENT OF WIRELESS TELECOMMUNICATION FACILITIES. MINIMIZE ADVERSE VISUAL EFFECTS OF WIRELESS TELECOMMUNICATION FACILITIES THROUGH CAREFUL SIGHTING AND DESIGN AND MINIMIZE ADVERSE IMPACTS ON THE NATURAL SCENIC, ENVIRONMENTAL, HISTORIC, CULTURAL, AND RECREATIONAL RESOURCES OF THE COUNTY. UH, AS PREVIOUSLY NOTED, NOTED, THE APPLICANT EXPLORED THE OPPORTUNITIES FOR CO-LOCATING ON EXISTING TOWERS IN THE AREA, BUT CO-LOCATING ON THESE TOWERS DOES NOT ACHIEVE THEIR COVERAGE GOALS. THE APPLICANT'S PLAN DOES COMPLY WITH ALL FEDERAL, STATE, AND LOCAL REGULATIONS REGARDING PROVIDING FUTURE CO-LOCATION OF EQUIPMENT ON THE EXISTING TELECOMMUNICATION TOWER AND EQUIPMENT SITE. IT'S APPLICANT'S INTENT TO DEVELOP THEIR TELECOMMUNICATION NETWORK WITHIN THE FRAMEWORK ESTABLISHED BY THE ABOVE STATED GOALS. ADDITIONALLY, THERE WILL BE NO IMPACT ON THE SUBJECT AND ADJACENT PROPERTIES CONCERNING BY RIGHT AGRICULTURAL FOREST ROLL AND RESIDENTIAL USES. UM, FURTHER LOOKING AT THE, UH, SETBACK REQUIREMENTS FOR TOWERS, UH, TOWERS MUST BE SET BACK A DISTANCE EQUAL TO 200% OF THE HEIGHT OF THE ANTENNA OR TOWER TO THE NEAREST RESIDENTIAL STRUCTURE. AND IN NO CASE LESS THAN 400 FEET, THE DISTANCE FROM THE PROPOSED TOWER TO THE NEAREST RESIDENTIAL STRUCTURE, UH, WHICH IS THE PROPERTY OWNER'S DWELLING, IS APPROXIMATELY 401 FEET. IN ADDITION, UH, THE ORDINANCE REQUIRES THAT ALL ANTENNA SUPPORT STRUCTURES MUST BE SET BACK 110% OF THE HEIGHT OF THE TOWER STRUCTURE FROM ALL PROPERTY LINES, AND THAT WOULD BE 219 FEET. AND THE PROPOSED LOCATION OF THE TOWER DOES MEET THE SETBACK REQUIREMENT. THE SETBACK FROM THE PROPOSED TOWER TO THE NEAREST PROPERTY LINE IS 222 FEET. AND, UM, JUST TO NOTE, THE ABUTTING PROPERTY, UH, AROUND THE TOWER IS OWNED BY THE SAME PROPERTY OWNER AS THE SUBJECT PROPERTY. UH, WE FEEL LIKE THE POTENTIAL IMPACTS ON THE SUBJECT PROPERTY ARE MINIMAL. UH, JUST THE IMPACT OF LOCATING THE TOWER ITSELF. ELECTRICITY AND BROADBAND FIBER ARE THE UTILITIES NEEDED TO DEVELOP THE SITE FOR THE TELECOMMUNICATIONS TOWER FACILITY. UM, THERE'S NO IMPACTS ON THE SCHOOL SYSTEM. UM, THE SECTION 1 0 6 FILING, UM, THEY'RE GOING THROUGH THAT, THAT PROCESS. AND, UM, THE REVIEW SHALL BE RECEIVED PRIOR TO THE ISSUANCE OF A BUILDING PERMIT, UH, VISIBILITY OF THE PROPOSED TOWER. UM, THEY DID DO A, A BALLOON TEST, UH, THROUGHOUT THE, UH, GENERAL AREA OF THE SUBJECT PROPERTY. AND REALLY THE TOWER COULD ONLY BE SEEN FROM, UH, LOCATIONS OF COURSE, UH, DIRECTLY IN FRONT OF THE SUBJECT PROPERTY. AND THEN FURTHER, UH, EAST ON, UH, EZINE ROAD, UH, YOU WOULD BE ABLE TO, UH, SEE THE TOWER, UH, OFF, OFF IN THE DISTANCE. UM, TRANSPORTATION ISSUES. BASICALLY, THE TOWER WOULD BE USING THE EXISTING, UH, GRAVEL DRIVEWAY ENTRANCE TO THE PROPERTY. UH, AT THE LAND DEVELOPMENT COMMITTEE, VDOT DID NOT HAVE ANY ISSUES, UH, WITH UTILIZING THAT EXISTING, UH, ENTRANCE TO THE SUBJECT PROPERTY. UH, STAFF HAS REVIEWED THE CONDITIONAL USE PERMIT REQUEST AND IS SATISFIED THAT WITH THE APPROPRIATE CONDITIONS, THE IMPACTS OF THE PROPOSED, UH, FACILITY ARE ADDRESSED. AND THE ISSUANCE OF THE PERMIT WOULD BE IN COMPLIANCE WITH THE INTENT, PURPOSE, AND DESIGN OF CHAPTER 22. UH, AND, UH, SECTION 22 DASH TWO OF THE, UH, ZONING ORDINANCE, UH, CONDITIONS THAT, UH, STAFF IS, UH, PROPOSE, UH, FOR THE CONDITIONAL USE PERMIT, OR ONE, THE IMPACT, UH, I'M SORRY. UH, LOOKING AT, UH, AT THE CONDITIONAL USE [00:10:01] PERMIT, UH, WE FEEL LIKE THE APPLICANT HAS ADDRESSED THE IMPACTS AND WITH THE CONDITIONS, UH, THE IMPACT, UH, PROPOSED BY STAFF, THE IMPACT OF THE PROPOSED TOWER WILL BE MINIMAL, GIVEN THAT THE PROPOSED TOWER WILL NOT HAVE DIRECT EFFECTS ON PUBLIC UTILITIES, THE TRANSPORTATION NETWORK, PUBLIC SAFETY SCHOOLS, AND WATER QUALITY, THE SUBJECT PROPERTY IS OF ADEQUATE ACREAGE, AND THE PROPOSED LOCATION OF THE MONOPOLE TOWER WILL NOT ADVERSELY IMPACT THEIR SURROUNDING USES AND THE PROPOSED LOCATION OF THE TOWER CONFORMS WITH THE GOALS OF THE RURAL CONSERVATION AREA SET FORTH IN THE COMPREHENSIVE LAND USE PLAN AND THE REQUIREMENTS OF THE ZONING ORDINANCE, UH, STAFF IS REC RECOMMENDING APPROVAL ALONG WITH THE FOLLOWING CONDITIONS. THE APPLICANT SHALL LIMIT THE HEIGHT AND TYPE OF WIRELESS TELECOMMUNICATE TELECOMMUNICATION TOWER TO THE 199 FOOT MONOPOLE TOWER, UM, UM, AND, UH, LOCATED ON THE 65 BY 65, UH, FOOT LEASE COMPOUND AREA. AS STATED IN THE APPLICATION, THE WIRELESS TELECOMMUNICATIONS TOWER FACILITY OWNER, UM, SHALL NEGOTIATE IN GOOD FAITH WITH THE COUNTY FOR PAID LEASE TOWER SPACE IF THE COUNTY SHOULD DE DESIRE TO LOCATE BROADBAND OR OTHER COMMUNICATIONS EQUIPMENT FOR COMMERCIAL OR LIKE SERVICES TO THIRD PARTIES. UM, THE MONOPOLE, UH, TOWER, UM, IS ENGINEERED TO ACCOMMODATE, UH, FIVE WIRELESS BROADBAND PROVIDERS AND THEIR EQUIPMENT. AND, UH, WE HAVE A CONDITION TYING THE, UH, PERMIT, UH, TO THE SITE PLAN, UH, THAT WAS, UH, SUBMITTED ALONG WITH THE APPLICATION. AND, UM, STAFF WOULD REVIEW THE APPLICATION AT LEAST EVERY TWO YEARS FOR COMPLIANCE WITH THE CONDITIONS, AND THE APPLICANT SHALL MAINTAIN COMPLIANCE WITH ALL FEDERAL STATE COUNTY'S RULES AND REGULATIONS, UH, RELATED TO THE WIRELESS TELECOMMUNICATION TOWER FACILITY USE. UM, YOU'LL NOTE THAT I DID NOT, UH, READ OUT, UM, IN YOUR PACKET, UH, CONDITION THREE THAT YOU HAVE. SO WE'VE, UH, RECOMMENDING THAT, UH, WE'VE REMOVED THAT, THAT CONDITION AND ARE NOT RECOMMENDING CONDITION THREE AS, AS PART OF THE APPROVAL OF THE PROJECT.
